Brandefense Academy (BA) is an education and training programme that enables participants to develop themselves in the fields of software and cyber security and provides certificates to those who successfully complete the training.
Users can access BA via secure variants of the POP3 or IMAP protocols with secure web access as well as its unique client program. Using BA is due to the terms mentioned below and by using BA, user is deemed to accept these terms. All or some of these terms may be changed wholly or partially by Brandefense Inc. or Brandefense Bilişim Danışmanlık Sanayi ve Ticaret A.Ş. (collectively, “Brandefense”) without a prior warning.
Copying, operating, re-operating, transmitting original or reproduced copies to the public by any means, selling, delivering or transmitting by any means, removing paid or free products of BA from the market or any kinds of rights related to BA, that have not been mentioned here, belongs to Brandefense.
User should use BA in the way the company has introduced and treating it by reverse engineering or by any other means, making it operate differently from the way it is introduced or violating any rights including the rights mentioned above is subject to legal sanctions.
BA is a free application but there may be some restrictions to the use of free version and there may be advertisement, promotion and suchlike applications. Besides, the free version may be removed indefinitely or subject to an additional limitation or application without a warning/announcement, or it may become liable to a fee.
Users that have bought pro account can take advantage of all the opportunities BA have presented or will present in the future in full without any limitation as long as their account is active.
Several user data, including but not limited to personal information of BA users, content of interactions with the server and data and file exchanges and similar traffic between the parties using the program, connection time information, source and destination IP addresses of the connection, names of commands passed through the connection, response times and program version, that indicates the promised service quality is provided is recorded and analyzed for a better user experience. Data other than user data (data about data) is not analyzed (except for spam analysis) and only recorded. In addition, in case of an error in the client code, information about the computer's hardware components and operating system is collected, analyzed and archived on the Brandefense server, using only for error analysis purposes. In case of deletion of user information, this information is kept in encrypted server backups for as long as necessary. It should also be noted that user data is collected and maintained by BA in accordance with the principle of confidentiality and relevant legislation. In this context, the data is not shared with third parties. However, if the legislation, court decision or the request of the authorized public institution requires data sharing, the data may be shared with the relevant authorities together with its backups.
Apart from the spam analysis examination, BA does not examine advertisements, user habits, content information, etc. on user e-mails. However, since users can access their e-mails by entering their password and user information, we recommend that users do not enter their password and user information into BA without taking the necessary security measures, and that they do not access BA from computers belonging to people they do not know or trust. Responsibilities regarding the safe use of BA and all the remaining risk are entirely with the user in every respect.
BA have no liabilities whatsoever for the unavailability of BA because of the lack or tardiness of the internet connection and/or that it cannot be used for any reason. Obtaining internet connection is the responsibility of the user.Even if it is not possible to run BA because of the clash with any hardware or software in user’s computer or because of any other reason and/or if there is any harm to user’s computer or to the data in user’s computer because of running BA, Brandefense has no liabilities related to the loss of data and hardware, and is not responsible to compensate the loss whatsoever.
Brandefense can delete the account of the users which they do not deem fit for any reason and/or prevent them from entering the system. They can prevent the connection of a certain IP range or the access of computer(s) that have a certain hardware component, to be able to realize this. In such case, user cannot claim any rights or make any demands.
For all these reasons, the user bears the risk of damage, loss of profit, loss, corruption and all other risks that may occur in the user's data, computer and similar elements as a result of not using the program safely by the user, not being able to use the program for any reason, or using the program.
Data and information on this website is considered to
be accurate, but this data and information may include inaccuracies and writing
errors. BA is provided "as is" without any representation
or warranty of any kind or condition, express or implied, “including but not
limited to the implied warranties of merchantability, fitness for a particular
purpose, title, and non-infringement”. BA does not warrant that the
functions on this site will be uninterrupted or error-free, that defects will
be corrected, that this site, including bulletin boards or the server that
makes the site available, will be error-free, free of viruses or other harmful
components. This disclaimer applies to any failure of performance, error,
negligence, interruption, deletion, defect, damage or injury caused by delay in
operation or transmission. Computer virus, communication line malfunction,
theft or breach of contract, tort or negligence; destruction or unauthorized
access, modification or use of records, whether due to any other action, is
prohibited. User expressly agrees that BA is not responsible for
the humiliating, insulting or illegal behavior of other subscribers or third
parties, and that any damage that may occur due to these is entirely on the
user. Unless otherwise restricted by applicable law, any person or entity
involved in creating, producing or distributing the BA application and
software shall not be liable for any damage under no circumstances, including
but not limited to, direct, indirect, incidental, special, consequential or
punitive damages resulting from the use or inability to use the BA application
and software or site. By this document, user confirms that the provisions
of this section will apply to all content on the site.
Unless otherwise restricted by applicable law, BA is not liable for any damages, including any special, indirect or incidental damages, in connection with the use of this site under any circumstances. BA recommends only the applications for the products specified in the catalogs or other company literature and disclaims any liability for the use of other them. The products are guaranteed only according to the terms and conditions of the sale, if guaranteed. User specifically acknowledges and accepts that BA shall not be liable for the minor, anti-competitive, insulative or illegal behavior of any user. If user is not satisfied with any BA material or terms and conditions; the one and only solution will be to stop using the site.
This Agreement will be governed by and construed in accordance with the laws of the Republic of Turkiye without prejudice to any policy or conflict of laws. If any provision of these Terms&Conditions become illegal, void or unenforceable for any reason, that provision will be separated from these terms and will not affect the validity and enforceability of other provisions.
Any dispute arising from or in connection with the interpretation and/or implementation of the Terms & Conditions shall be finally settled through binding arbitration in accordance with the Istanbul Arbitration Centre (ISTAC) Arbitration Rules. The number of arbitrators shall be 1 (one), the language of arbitration shall be English, and the place of arbitration shall be Istanbul, Republic of Turkiye. All proceedings, including the outcome of the arbitration, shall be kept confidential. Nothing in this article shall prevent any Party from seeking interim or injunctive relief from competent governmental authorities or courts to protect its interests or the valid status of the Parties before or during arbitration proceedings.
User should not use BA if it does not accept any of these terms.
